Clay County Commissioners negotiate liability with cable provider

CLAY COUNTY – Future liability of fiber optic lines was on the agenda when the Clay County Commissioners met Tuesday.

Elizabeth James and attorney Brett Vanlandingham asked the commissioners to change the wording in Charter Communications’ contract with the county. Charter is set to install fiber optic cable in about 1,500 homes throughout Clay County, including Brazil, by 2025.

Charter’s attorney expressed concern about wording in the proposed contract. He said the wording appeared to mean that whatever damage occurred to Charter’s lines and other equipment would be the company’s responsibility. He wanted wording to say that if someone intentionally damaged Charter’s property, that person or the county would be held accountable.

After discussion, it was agreed the contract needs further negotiation before it is signed.
